DNA TESTING CONTINUES IN COCHISE COUNTY CHILD SEX ABUSE INVESTIGATION‼️
BISBEE, Ariz. — New court records indicate investigators with the Cochise County Sheriff’s Office are awaiting forensic DNA testing results that could either connect or eliminate another potential suspect in an ongoing child sexual abuse investigation.
The case centers on Mark E. Berty, 59, of Palominas, who currently has three pending felony cases in Cochise County Superior Court. Two of those cases involve allegations of sexual offenses against a girl who was 14 years old at the time, while a third case alleges prohibited possession of a firearm based on a prior felony conviction in Washington.
According to court documents, detectives submitted several items of evidence for forensic DNA analysis after the victim reported having sexual contact with more than one individual. An earlier report from the Arizona Department of Public Safety crime laboratory reportedly identified DNA consistent with Berty’s profile, while also indicating the presence of two additional unidentified DNA profiles.
Court records state that, during the course of the investigation, the victim’s father provided detectives with the names of three additional individuals he believed may have had contact with his daughter. Investigators also obtained descriptive information from the victim that was reportedly consistent with information provided by her father.
Last month, a Cochise County Superior Court judge authorized a search warrant requiring one of those individuals to provide a saliva sample for DNA testing. Court records indicate the warrant was served on July 5, and investigators are awaiting the Arizona Department of Public Safety crime laboratory’s comparison results.
The documents also indicate the victim’s mother asked investigators whether the father’s DNA would also be tested. According to the records, the lead detective advised there was no evidence indicating the father had engaged in any sexual misconduct.
The additional individual who provided the DNA sample has not been charged with any crime, and court records indicate the DNA testing is intended to determine whether that individual can either be connected to or excluded from the investigation.
Meanwhile, Berty remains out of custody after posting bond and is scheduled to appear in Cochise County Superior Court for a hearing on August 3. In addition to the original charges filed earlier this year, prosecutors later added 11 counts of aggravated harassment and one count of child enticement to facilitate the sexual abuse of a minor, according to court records.
As with all criminal proceedings, the charges against Berty remain allegations, and he is presumed innocent unless and until proven guilty in a court of law.

Residents Voice Concerns During Citizen Review Meeting on Proposed 109-Acre Light Industrial Rezoning
SIERRA VISTA, Ariz. — July 29, 2026 — A Citizen Review Meeting regarding a proposed 109-acre Light Industrial (LI) rezoning request drew dozens of attendees Wednesday evening, with many nearby property owners expressing opposition to the proposal and raising questions about its potential impacts on the surrounding rural community.
The applicant is seeking to rezone the property from its current Rural (RU-2) designation to Light Industrial (LI). During the meeting, residents asked questions about the future use of the property, noting that no specific businesses or industrial tenants were identified during the presentation.
According to those in attendance, approximately 27 residents participated in the meeting. Several county officials were also present as observers, including a member of the Cochise County Board of Supervisors, members of the Planning and Zoning Commission, and representatives from the county planning office.
Throughout the meeting, residents shared a number of concerns regarding the proposed rezoning, including:
* Groundwater: Several attendees expressed concern about the proposal’s potential impact on groundwater resources. According to information discussed during the meeting and included in the rezoning application, the property could be subdivided into multiple parcels, with each parcel potentially eligible to develop an individual well capable of pumping up to 10,000 gallons of groundwater per day, subject to applicable laws and regulations. Residents said they are concerned that, if fully developed in that manner, the cumulative groundwater demand could affect the area’s aquifer and nearby private wells, which serve as the primary water source for surrounding homes.
* Population Growth and Economic Need: Some residents questioned the need for additional industrial zoning in the area, citing information from the county’s Comprehensive Plan that they said reflects modest long-term population growth. They argued that existing industrially zoned properties may already provide sufficient capacity for future development.
* Traffic and Emergency Access: Residents also raised concerns about the area’s roadway infrastructure, noting that nearby residential streets are limited in size and access. They questioned how increased commercial or industrial traffic could affect public safety and emergency vehicle access if the project is developed in the future.
* Existing Industrial Property: Several attendees pointed to existing vacant industrial and commercial properties within the City of Sierra Vista, suggesting those locations could better accommodate future industrial development. Others noted that the proposed property is located in unincorporated Cochise County and is not within the city’s jurisdiction.
According to information presented during the meeting, the applicant has requested that consideration of the rezoning be postponed until September, delaying its appearance before the Cochise County Planning and Zoning Commission.
Additional public meetings and opportunities for public comment are expected before the proposal is considered by the Planning and Zoning Commission and, ultimately, the Cochise County Board of Supervisors.
